Terms of Service

These Terms of Service (“Terms”) govern the relationship between Next Home Property Management (“Company,” “we,” “our,” or “us”) and property owners, tenants, and prospective clients (“you,” “your”) who use our property management services in North Carolina and South Carolina. By engaging our services, you agree to these Terms.


1. . Scope of Services

We provide property management services, which may include:

•    Marketing and advertising rental properties

•    Tenant screening and placement

•    Lease preparation and administration

•    Rent collection and accounting

•    Routine property inspections

•    Coordination of repairs and maintenance

•    Enforcement of lease terms

•    Compliance with applicable landlord-tenant laws in NC and SC

Services provided may vary by agreement. A written management agreement will outline specific responsibilities, fees, and expectations.

 

2. Legal Compliance

We operate in compliance with all applicable federal, North Carolina, and South Carolina laws, including:

•    State landlord-tenant statutes

•    Fair Housing Act and state fair housing regulations

•    State and federal privacy laws

•    Real estate licensing requirements

You are responsible for ensuring that your property is compliant with applicable housing codes, zoning laws, and safety standards.

 

3. Fees and Payments

•    Management fees, leasing fees, maintenance fees, and other charges will be set forth in the signed property management agreement.

•    All payments are due as specified in that agreement.

•    We reserve the right to adjust fees with appropriate notice, in accordance with the agreement.

 

4. Owner Responsibilities

Property owners agree to:

•    Provide accurate information about their property

•    Maintain adequate insurance coverage

•    Set aside funds or allow disbursement of rental income for repairs, maintenance, and emergency expenses

•    Indemnify and hold the Company harmless from claims arising out of ownership of the property, except where caused by our gross negligence or willful misconduct

 

5. Tenant Responsibilities

Tenants placed by us must comply with all lease terms, including timely rent payment, proper property care, and adherence to community rules. Tenants are subject to applicable North Carolina and South Carolina landlord-tenant laws.

 

6. Limitation of Liability

•    We act as an agent for property owners. We are not responsible for losses caused by tenant actions, market conditions, or property defects.

•    To the fullest extent permitted by law, our liability to you for any claim is limited to the amount of management fees paid to us in the twelve (12) months preceding the claim.

 

7. Termination

The property management agreement may be terminated by either party in accordance with the termination provisions stated in that agreement. Any outstanding fees, expenses, or obligations must be settled before termination is effective.

 

8. Privacy and Communications

•    We maintain the confidentiality of owner and tenant information in compliance with state and federal laws.

•    Mobile opt-in data and consent will not be shared with third parties or affiliates.

•    Communications may be sent via phone, email, or SMS as permitted under applicable law.

 

9. Dispute Resolution

•    Any dispute arising under these Terms or the property management agreement shall first be attempted to be resolved through good-faith negotiation.

•    If unresolved, disputes may be submitted to mediation or binding arbitration in the state where the property is located, unless otherwise prohibited by law.

 

10. Governing Law

These Terms and all agreements are governed by the laws of the state where the property is located (North Carolina or South Carolina).

 

11. Changes to Terms

We may update these Terms at any time. Updates will be effective upon posting or notice to you. Continued use of our services constitutes acceptance of the revised Terms.
